Judge Upholds Ban on Polygamous Marriage * ~~ * ~~ * ~~ * ~~ * ~~ * ~~ * ~~ * ~~ * ~~ * The more the merrier by Paige Worthy University Daily Kansan February 24, 2005 If love is what makes the world go 'round polyamory might be what's keeping the world turning. It was a classic case of boy meets girl ... meets girl. When Rob Hamm, Catherine Glewwe and Shannon Henry met, each says it was infatuation at first sight. Rob and Cat met first, in 2000, at a gaming conference, and Cat eventually moved to Lawrence from Minnesota to live with Rob. She confessed to him that she'd always wanted to date other women but that she was already so deeply in love with him that she didn't want a relationship that didn't include him. Rob says he jumped at the opportunity to be in a relationship with two women, so he agreed to keep on the lookout for a new woman who would mesh with both their personalities. Enter Shannon. Rob first met Shan, who was living in Pennsylvania until early January 2005, through their online journals, but they met in person at another gaming conference, where they had arranged to share quarters, and the two immediately hit it off. Rob says that when the two women finally met in person last October, the chemistry was obvious. The three now live together in Lawrence and are what is known as a polyfidelitous triad, or polyfi triad for short. Polyfidelity is one many divisions of polyamory, which literally means "many loves". Polyfidelity differs from a monogamous relationship in that people form multiple romantic relationships with more than just a spouse, girlfriend or boyfriend. It's not cheating because their partners always know about it. And it's not swinging, where swinging involves sex exclusively, polyamory is more concerned with emotions and relationships. Last Thursday, for example, the casino boss whom investigators find dead in his driveway turns out to have been an infantilist -- a man who gets sexual pleasure by pretending to be a baby (with a woman who coddles him, disciplines him, and, yep, breast-feeds him). The plotline was lurid, the flashback scenes explicit and the one-liners beyond glib. An episode last November, set partly in gay bars and pivoting on the genital mutilation of a transsexual, was the highest-rated episode of any series on television for that sweeps month, with 32 million viewers. (CSI star William Petersen has said he thought that episode might have gone too far.) A couple of weeks before that, a show about a man raping and killing college coeds managed to work in S&M comic books and a blow-up sex doll. Looking for a stern, leather-clad dominatrix? Lady Heather has whipped up passions in two episodes. CSI has so much sex on the brain that an episode about a roller-coaster car jumping the track and killing all aboard turned out to hinge on teen-agers having sex on the coaster. She's been charged with prostitution after Hillsborough County sheriff's detectives (along with the Postal Service) raided her suburban Brandon home and found what has been described in media reports as a sex dungeon. They allege that Devine offered to perform anal sex and genital torture in exchange for $850. Both the Tampa Tribune and St. Petersburg Times carried accounts of the arrest. But the stories diverged widely in their tone. We offer these excerpts: Times: Related that Mistress Lulu's defense is that "First of all, I'm gay." Tribune: No mention of sexual orientation, but it did quote liberally from her reported Web site: "Come to me, now. Come to me on your knees. Come to me ready to show me why you should be in my presence. ... I am available for domestic and international travel and tribute starts at $600. 24 hour notice is needed." Times: Described the dungeon (based on a reporter's tour of it): "A man-sized cage with fake skeletons sat in the corner, next to a desk with a home computer. Devine also kept her pet squirrel, Gonzo, there." Tribune: "The room had a concrete floor, black walls, and various sadism and masochism devices hanging from the ceiling and walls, sheriff's deputies said." Mistress Lulu, identified by Hillsborough County sheriff's officials as Cynthia Stathopoulos, 49, was arrested about 7:30 p.m. at her home at 3408 Westfield Drive on a charge of prostitution. Authorities say she had converted a bedroom there into a dungeon. Sheriff's spokeswoman Debbie Carter said someone tipped sheriff's detectives to the alleged prostitution activities. Detectives began investigating and found a Web site Stathopoulos maintained. "Are you ready to turn your fantasy into reality?" the site asks. "Come to me, now. Come to me on your knees. Come to me ready to show me why you should be in my presence. ... I am available for domestic and international travel and tribute starts at $600. 24 hour notice is needed," the Web site says. An undercover detective contacted Stathopoulos and mailed her a money-order deposit, Carter said. Called Private Encounters, the small club at Central Avenue and 11th Street will offer lingerie modeling and dancing for customers in private rooms. It will also host bachelor parties and provide body rubs, said owner Barbara Bransford. Bransford has obtained a valid business license for her establishment, at 328 S. Central Ave., Suite 201, from the city of Medford. The maximum occupancy is 22 people, and the license does not list serving food or beverages, according to Kathy Cannon in the Finance Department. The license also says Bransford plans to build a "dungeon" for entertainment at a later date. Bransford described the "dungeon" as "bondage and dominance-type stuff - that sort of entertainment." Joyce Lloyd of the Heart of Medford Association does not believe that kind of entertainment is appropriate for downtown. Medford police Lt. Tim George said police spoke extensively with Bransford and explained what she legally could or couldn't do as the owner of a sexually oriented business. "The other thing that is a bit of concern for me is this dungeon. We'll have to see it first," he said. "It's unlawful to commit sadomasochism or sexual conduct in a live show." If the organizations do not write constitutions by fall 2005, they will not be recognized at Iowa State and will not receive the benefits, said Laura Bestler-Wilcox, assistant director of student activities. Groups that are not recognized by Iowa State would not be able to use any of the campus resources, such as meeting rooms in the Memorial Union, available to recognized groups. Ethan Newlin, president of ISU Live Music Club and Daily columnist, said his club did not have a constitution either, but is planning to implement one. Newlin said he assumes the constitution requirement and Student Organization Review Board are being implemented because of budget issues and the controversy over Cuffs. Cuffs, a bondage and sadomasochisism club on campus, was reprimanded after it had demonstrated BDSM techniques at one of its meetings. "It's a measure to cut down on frivolous clubs and to make sure each club is committed," Newlin said. "There are two sides to this point: One, the university is embarrassed because of Cuffs, and they want to put their best face forward and cover their tracks. Two, students should have to the right to represent themselves." U.S. District Judge Ted Stewart on Wednesday rejected the argument that the state's ban on polygamy violates constitutional rights of religion and privacy, saying the state has an interest in protecting monogamous marriage. The judge emphasized his ruling was about marriage, not personal sexual conduct. He cited cases as far back as an 1878 Supreme Court ruling upholding the polygamy conviction of George Reynolds, personal secretary to Mormon pioneer leader Brigham Young. Stewart said the 2003 Supreme Court ruling in Lawrence v. Texas, which found that a Texas anti-sodomy law violated the privacy of consenting adults, did not apply to the Utah case.
